REQUEST FOR EXAMINATION OF A WORK BY THE JEAN HELION COMMITTEE

1- IDENTIFICATION OF THE APPLICANT FOR THE REVIEW
Requests for advice should be addressed to the Jean Hélion Committee by post to the Association Jean Hélion’s head office: 2 rue Gounod 75017 Paris and by email contact@associationjeanhelion.fr.
1. You wish to request the opinion of the Jean Hélion Committee on the authenticity of the work described above and wish it to be included in the catalogue raisonné of paintings or works on paper that the Committee is preparing. Once signed by you and the Jean Hélion Committee, this request will constitute the basis of your agreement. In this regard, you expressly warrant and declare that all the information you provide is accurate and complete.
2. By submitting a work to the Jean Hélion Committee, you declare that you are the legal owner of the work or its duly authorized agent by virtue of a power of attorney which you can justify at the first request of the Jean Hélion Committee.
It is specified that a copy of the owner’s and/or agent’s identity card must be attached to the file, failing which the Committee may refuse to examine the application for authentication.
For legal entities, an up-to-date Kbis (official registred mark) extract will be requested.
3. When submitting your request for an opinion, you undertake to provide the Committee with the following documents and information:
(1) a copy of your identity card or passport;
(2) a full description of the work (title, medium, possible inscriptions, unframed dimensions), any previous provenance of the work of which you are aware, exhibitions or publications in which the work may be mentioned and/or reproduced;
(3) professional quality, royalty-free colour photographs of the front and back of the work and an enlargement of the signature.
The photographs and documents submitted to the Jean Hélion Committee may be kept by the latter for scientific, archival or exhibition purposes. During the examination of the work, you authorise the Jean Hélion Committee to take any photographs of the work that are deemed necessary and to reproduce them by any means, on any medium and at any time.
4. By submitting a work to the Jean Hélion Committee, you expressly declare that you are seeking an opinion on the attribution of the work to Jean Hélion (1904-1987).
5. At the request of the Jean Hélion Committee, you undertake to make the work available to it in a place designated by it. The deposit of the work will take place by appointment and you will organise, at your own expense, the nail-to-nail insurance, packaging, delivery and collection of the work, according to the date, time and place specified by the Jean Hélion Committee.
6. Only complete files will be examined by the Jean Hélion Committee, whose opinion is subject to the payment of the following fees, subject to applicable taxes, it being specified that these fees may be reviewed at the discretion of the Jean Hélion Committee depending on the period of completion of the work submitted for an opinion:
(1) Paintings (oil or acrylic, any medium): € 400.00
(2) Drawings and watercolours (and similar techniques, any medium): € 250.00
These fees are payable by cheque made out to the Committee or by bank transfer.
For works already submitted and approved by Jacqueline Hélion for inclusion in the “Catalogue of Jean Hélion’s Paintings”, a confirmation letter/inventory number is available on request, subject to an administration fee of €100.00
7. The Jean Hélion Committee will examine the work at its sole discretion and at a time deemed appropriate. No work will be examined with its frame or with an added base or support. Any frame, stand or support must be removed at your expense before the work is examined by the Committee.
8. During the transport to and from the exhibition and for the duration of the examination of the work by the Jean Hélion Committee, you undertake to insure the work entrusted to you against all conventional risks with the insurance company of your choice and at your own expense, for an amount equivalent to its insurance value, which you will have to justify.
9. The Jean Hélion Committee undertakes to use its best knowledge to provide you with an opinion on the authenticity of the work, but cannot be held to an obligation of result.
In this regard, you acknowledge that the opinion of the Jean Hélion Committee concerning the attribution of the work to Jean Hélion (1904-1987) is independent and impartial and that it is made to the best of its knowledge and according to the information available at the time of its examination.
The Jean Hélion Committee may at any time revise its opinion concerning the attribution of the work to Jean Hélion.
10. The Jean Hélion Committee may, as the case may be
(1) Affirm that the work is authentic and can be attributed to Jean Hélion,
(2) State that the work is not authentic and cannot be attributed to Jean Hélion,
(3) To state that it is unable, as of the date of the review, to provide an opinion regarding the attribution of the work to Jean Hélion.
Works deemed authentic will be included in a digital inventory and/or catalogue raisonné of the artist’s works on canvas or paper and an inventory number will be issued as a certificate of authenticity.
11. The results of the examination as well as an invoice for the related costs, referred to in point 6 of the present document, will be sent to you by mail or e-mail within two to three weeks following the date of examination of the work by the Jean Hélion Committee.
12. The sending of a request for examination for authentication of a work by the Jean Hélion Committee does not constitute an assurance that the work will be included in the catalogue raisonné of Jean Hélion (1904-1987).
The Comité Jean Hélion decides at its own discretion on the inclusion of authenticated works in the various catalogues raisonnés in preparation and shall not be held liable in the event of a refusal to include a work in a catalogue.
13. The Committee expressly disclaims any liability to you or any other person for any reason whatsoever in connection with its conduct, activities and the giving of its advice under this agreement. As such, the Jean Hélion Committee shall not be liable for any loss of value or damage that may result from the examination of the work and/or its opinion as to whether or not it is attributable to Jean Hélion (1904-1987).
14. You acknowledge that you are aware that the opinion of the Jean Hélion Committee may be negative or indeterminate and you expressly waive the right to bring any action or proceeding, on any grounds whatsoever and for any reason whatsoever, against the Jean Hélion Committee, any of its members or the authors of the catalogue raisonné.
Under no circumstances shall the Jean Hélion Committee or its members, whether or not they have signed the notice that will be given to you, incur any liability whatsoever concerning the content of this notice. In this respect, no legal action or claim of any kind will be made by you against the Jean Hélion Committee on the basis of this notice and you expressly, knowingly and voluntarily waive this right.
15. This agreement is governed by French law and exclusive jurisdiction is given to the Paris Courts.
